Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Somery iOS app ("Service") operated by the Somery team ("we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms.

1. About Somery

Somery is a personal dream journaling and AI interpretation app available on iOS. It lets you record dreams, attach mood and sleep metadata, generate AI-powered interpretations and visualisations, and optionally sync your journal to the cloud.

2. Eligibility

You must be at least 13 years old to use Somery. By creating an account you confirm that you meet this age requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

3. Subscriptions and Billing

Access to AI interpretation features requires an active subscription or remaining interpretation credits. Somery offers the following plans:

• Weekly — billed weekly.
• Monthly — billed monthly, includes a 3-day free trial.
• 3-Month — billed every three months.

All subscriptions are managed through Apple's App Store and StoreKit. Billing, cancellation, and refunds are handled entirely by Apple under Apple's own terms and policies. We do not process payments directly and have no access to your payment information.

To cancel a subscription, manage it through your Apple ID settings. Your subscription will remain active until the end of the current billing period.

4. AI Disclaimer

Dream interpretations generated by Somery are produced by artificial intelligence and are intended for entertainment and personal reflection only. They are not a substitute for medical, psychological, therapeutic, or any other professional advice or treatment.

If you are experiencing mental health difficulties, emotional distress, or any medical condition, please consult a qualified professional. Do not delay or disregard professional advice based on anything generated by the app.

5. Your Content

You own the dream journal entries and other content you create in Somery. By using the AI interpretation feature, you grant us a limited, non-exclusive licence to transmit that content to our AI provider (OpenAI) solely for the purpose of generating your requested interpretation. We do not use your dream content to train AI models.

You are responsible for the content you enter. Do not submit content that is unlawful, harmful, or that violates the rights of others.

6. Acceptable Use

You agree to use Somery for lawful, personal purposes only. You must not:

• Use the app to harass, abuse, or harm any person.
• Attempt to reverse-engineer, decompile, or tamper with the app.
• Use automated tools to scrape or extract data from the Service.
• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.

7. Intellectual Property

The Somery app, including its design, code, branding, and original content, is owned by us and protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of or inability to use the Service. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time through Settings → Data Management in the app. Upon termination, your right to use the Service ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the app after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

This agreement is governed by the laws of Ukraine, without regard to its conflict of law provisions.
